Article 1 Scope of Application
1.Accommodation contracts and related contracts that inn Miyama (hereinafter referred to as “inn-Miyama”, “we”, “our”, or *us”) enters into with guests shall be governed by these terms and conditions, and any matters not stipulated in these terms and conditions shall be governed by laws, regulations or generally accepted practices.
2.Notwithstanding the provisions of the preceding paragraph, in the event that inn-Miyama accepts a special agreement within the scope that does not contravene the intent of laws and regulations, and customs, such special agreement shall take precedence over these terms and conditions.
Article 2 Reservation Request
1.A person who wishes to apply for stay in inn-Miyama shall be required to provide us with the following information:
(1) Name of guests;
(2) Date of stay and estimated arrival time
(3) Name and contact details of applicant and the person paying the accommodation fee;
(4) Number of guests; and
(5) Any other matters inn-Miyama requires.
2.In cases where a guest applies for extension of stay period beyond the date of stay set forth the item 2 of the preceding paragraph during his/her stay, this will be treated as new an application for accommodation contract only if there is no other reservation at inn-Miyama and we accept the application.
Article 3 Payment of Reservation deposit
1.The person making a reservation with preceding article must pay the reservation deposit (total accommodation fee) at the time of application.
2.The reservation deposit shall first be applied to the accommodation fee that is payable by the guest, and in the event that the provisions of Articles 8 and 20 shall apply, the reservation deposit shall be applied in the order of cancelation charges followed by damages, and the remaining amount, if any, shall be refunded at the time of payment pursuant to the provision under Article 13.
Article 4 Concluding of Accommodation Contract
1.An accommodation contract shall come into effect when inn-Miyama accept the application as set forth in the previous article. The order of establishment of accommodation contracts shall be determined by the order of acceptance of accommodation reservations as set forth in Article 2.
2.If the reservation deposit is not paid by the due date as set forth in Article 3, paragraph inn-Miyama shall treat the relevant reservation as if it had never been made.
3.Once an accommodation contract has been established, inn-Miyama will not be able to accommodate any changes to the accommodation date thereafter. If the guest wishes to change the accommodation date for their own reasons, they will need to cancel the accommodation contract in accordance with the cancellation of the accommodation contract as set forth in Article 7 and then apply for a new accommodation reservation.
Article 5 Special Agreement not to Require Deposit
1. Notwithstanding the provisions of Article 3, inn-Miyama may accept a special agreement not to require payment of the reservation deposit.
Article 6 Refusal to Enter into Accommodation Contract
1.inn-Miyama may reject to conclude Accommodation Contract in the following cases.
(1)When the application does not conform to these terms and conditions.
(2)When the hotel is fully booked and there are no rooms available.
(3)When it is deemed that the person seeking accommodation is likely to act in a manner that violates the provisions of laws and regulations, public order, or good morals in relation to their accommodation.
(4)When it is deemed that the person seeking accommodation falls under the following items.
A)An organized crime group designated in the item 2 of Article 2 of the Law on the Prevention of Unjust Acts by Organized Crime Group Members (Law No. 77 of 1991) (hereinafter referred to as “Organized Crime Group”), an organized crime group member set forth in the item 6 of Article 2 of the same law (hereinafter referred to as “Organized Crime Group Member”), an associate member of Organized Crime Group or a person related to Organized Crime Group or other antisocial forces;
B)corporate entity or other organization whose business activities are controlled by an Organized Crime Group Member or an Organized Crime Group Member; or
C)A corporate entity whose directors or officers fall under Organized Crime Group Member.
(5)When a person seeking accommodation makes violent demand or demands a burden beyond the reasonable range to us or our employees.
(6)When a person seeking accommodation is clearly recognized as carrying an infectious disease.
(7)When inn-Miyama is unable to accommodate the guest due to natural disasters, breakdown of facilities, or other unavoidable reasons.
(8)When a person seeking accommodation is likely to cause a nuisance and something that is disturbing to the neighborhood or other guests due to drunkenness, etc.
(9)When a person seeking accommodation is bringing in hazardous materials (firearms such as stoves, petroleum, firearms, swords, etc.) or items harmful to the human body
Article 7 Right of Cancellation by the Guest
1.A guest may cancel the Accommodation Contract by notice to inn-Miyama.
2.If the guest cancels the accommodation contract in whole or in part due to reasons attributable to the guest (excluding cases where inn-Miyama has requested the payment of reservation deposit in accordance with the provisions of Article 3, paragraph 1, but the cancellation was made prior to the payment of the deposit), inn-Miyama will charge a penalty as listed in Article 22.
3.If the guest, without informing us, does not arrive at inn-Miyama by 8:00 p.m. on the day of the stay or within 2 hours after the agreed arrival time, the accommodation contract will be deemed to have been canceled by the guest and processed accordingly.
Article 8 Termination Right of inn-Miyama
1.inn-Miyama may terminate the Accommodation Contract in the following events:
(1)In the event the guest falls under any of Article 6.(3)to 6.(9)
(2)When the guest engages in behavior that is an impediment to fire prevention, including, but not limited to smoking in designated non-smoking or tampering with fire-fighting equipment.
(3)When the guest lets any person other than guests enter the guest room regardless of whether temporarily or not;
(4)When the guest removes equipment or items belonging inn-Miyama without permission;
(5)When the guest attempts to make changes, alterations, or modifications to the building or facilities of inn-Miyama;
(6)When a double booking occurs in relation to the accommodation.
(7)When false information is found in the registration or application for accommodation under Article 8
(8)When the guest does not comply with any other rules of use established by inn-Miyama.
2.In cases where inn-Miyama terminates the Accommodation Contract in accordance with the provisions of the preceding paragraph, inn-Miyama will not charge the guest for any accommodation service or other services not yet provided by inn-Miyama.
Article 9 Registration of accommodation
1.A guest shall complete registration of the following items upon check-in to inn-Miyama:
(1)Name, age, gender, contact information, address and occupation;
(2)For non-Japanese, nationality and passport number;
(3)In addition to above, in the case of a non-Japanese who does not have a domicile in Japan, a copy of his/her passport.
(4)Dete and estimated time of departure;
(5)Other matters deemed necessary by us.
Article 10 Hours of Use of Our Facility
1.The hours in which a guest can make use of the inn-Miyama’s facility shall be as set forth below;
Check in: at 3:00 p.m.~ / Check out: at ~ 10:00 a.m.
In the case of consecutive nights stay (2 or more nights), the facility may be used all day except on the arrival and departure days.
2.Notwithstanding the provisions of the preceding paragraph, inn-Miyama may permit the use of its facility outside the hours specified as the following. Late check-out is possible until noon, but if there are no other guests making reservations on the check-out date, you may stay until 3:00 p.m.. The fee is 3,000 yen (tax included) per person per hour. Early check in is at 1:00 p.m. The fee is 3,000 yen (tax included) per person per hour
Article 11 Compliance with the rules of use
1. In the premises of inn-Miyama and Shoda Village, the guests must comply with the rules of use established by us posted within inn-Miyama.
Article 12 Key Handover
1.The key to inn-Miyama will be handed over to you in person at check-in. The key must be returned at check-out. If you lose the key, a fee of 3,000 yen will be charged (C)
Article 13 Payment
1.The breakdown and calculation method of the accommodation fee payable by the guest shall be as set forth in Article 21.
2.Payment of the accommodation fee in the preceding paragraph shall be made by cash or an alternative method such as a credit card approved by inn-Miyama at the time of the guest’s departure or when requested by inn-Miyama.
3.Accommodation fees shall be payable even if the guest voluntarily does not stay inn-Miyama after the facility is provided to the guest and made it available for his/her use, or if the guest voluntarily cancels the stay after using the room.
Article 14 Responsibility of inn-Miyama
1.inn-Miyama will compensate for any damages caused to the guest in course of performance of the accommodation contract and related agreements, or in the event of failing to perform in accordance with such. However, this does not apply if the damages are not attributable to inn-Miyama.
2.inn-Miyama has taken out liability insurance to deal with the unlikely event of a fire, etc.
3.inn-Miyama will not be held responsible for any injuries that occur within the facility, regardless of whether they are caused by intent or negligence (C).
4.inn-Miyama will not be held responsible for any injuries, burns, or fires caused by the use of any equipment and tools, including wood stoves.
Article 15 Handling of cases where contracted room cannot be provided
1.In case inn-Miyama is unable to provide a contracted room to the guest, inn-Miyama shall, with the guest’s consent, arrange for the guest to stay in another accommodation with similar conditions to the extend possible.
2.In spite of the provisions of the previous paragraph, when inn-Miyama is unable to arrange for the guest to stay in another accommodation, inn-Miyama shall pay the guest a compensation fee equivalent to the penalty, which shall be applied to cover the damages. However, the inability to provide alternative accommodation is not attributable to inn-Miyama, no compensation fee will be paid.

Article 16 Handling of Deposited property
1.inn-Miyama does not handle any deposited items. We are not responsible for any loss, damage, or other loss of or damage to any items, cash, or valuables brought into inn-Miyama by guests.
Article 17 Storage of Guest’s Baggage and Belongings
1.Valuables, excluding the guest’s baggage, cannot be received or stored prior to the stay.
2.If the guest’s baggage or belongings (including those in the safe) are left behind at inn-Miyama after the guest checks out and the owner is identified, we will contact the owner and ask for instructions. However, if there are no instructions from the owner or the owner is not identified, we will, in principle, store the items at inn-Miyama for seven days, including the day they were found, after which the valuables will be turned in to the nearest police station and other items will be disposed .
Article 18 Responsibility for Car Parking
1.When guests use the inn-Miyama’s parking lot, inn-Miyama is merely lending the parking space and is not responsible for custody or management of the vehicles.
Article 19 Responsibility of Guest
1.In the event that inn-Miyama suffers damage caused by the intentional or negligent act of a guest, the guest may be required to compensate inn-Miyama for the damage.
Article 20 Disclaimer
1.Guests shall be responsible for their own use of computers and other communication devices in the facility of inn-Miyama. we shall not be liable for any damages incurred by guests as a result of service interruptions caused by system failures or other reasons while using computers or other communication devices.
2.Furthermore, if damage is caused to inn-Miyama or a third party due to an act that inn-Miyama deems inappropriate for the use of computer communications, the guest may be required to compensate for the damage.
Article 21 Breakdown of accommodation fees, etc. (related to Article 13)
1.Total amount to be paid by the guest: The total amount of accommodation fee, additional fee (optional service), and tax (consumption tax) will be based on the price list posted on the hotel’s website. The normal price will be charged for guests aged 6 and over, but the accommodation fee for children under 6 years old is free if they do not require bedding, and 30% of the normal price if bedding is required. However, if the guest has made the reservation via an online travel agent, the price set by that agent shall take precedence.
Article 22 Penalty (related to Article 7)
1.No penalty will be charged if the notice of termination of the accommodation contract (cancellation) is received 15 days prior to the scheduled check-in date. A penalty of 50% of the accommodation fee will be charged if the notice is received between 14 and 8 days prior, 80% of the accommodation fee (including price of the reserved breakfast) will be charged if the notice is received between 7 and 1 day prior, and 100% of the accommodation fee (including price of the reserved breakfast) will be charged if the guest does if the notice is received on the day of check-in or does not arrive.
2.However, if there is a different cancellation fee is applicable for a particular plan, the cancellation fee set for the plan will prevail.)
3.Furthermore, if the guest makes a reservation via an online travel agent, the penalty fee set by each agent shall take precedence.
Article 20 Governing Law and Jurisdiction
1.Any and all disputes arising in connection with these terms and conditions shall be resolved in accordance with the laws of Japan in the Kyoto District Court and the Kyoto Summary Court having jurisdiction over the location of this facility.
Rules of Use
1.The rules of use in inn-Miyama are as follows.
(1) In principle, entry to inn-Miyama by anyone other than registered guests is prohibited. If a non-registered person stays overnight in inn-Miyama, the guess will be charged the same accommodation fee for the person.
(2) Do not use firearms or other items that could cause a fire within the facility.
(3) Smoking is completely prohibited inside the building of inn-Miyama. Smoking within inn-Miyama is limited to designated outdoor smoking areas.
(4) As inn-Miyama is located in a middle of the village, please refrain from singing loudly, making noise, or engaging in other behavior that may cause a nuisance to neighboring residents.
(5) Do not gamble or engage in any behavior that may be offensive to public morals within the premises of inn-Miyama.
(6) Any equipment or items within the facility may not be moved, modified, or taken out to other locations, or used for purposes other than those intended.
(7) Do not bring the following items into the facility.
A) Items that emit an extremely foul odor.
B) Items that are in a significantly large quantity
C) Items that are easily ignite or catch fire, such as gunpowder or volatile oils
D) Firearms or swords that are not legally permitted to be possessed
E) Marijuana, narcotics, stimulants, etc.
2. The rules within Shoda Village are as follows.
(1) In principle, you may only enter paved roads, and you may not enter private property.
(2) The speed limit for cars and motorcycles is 20 km/h.
(3) Do not collect flowers, fruits, plants, or trees without permission.
(4) Do not park in any area other than the designated parking areas for inn-Miyama.
(5) Do not set off fireworks.
(6) Be considerate of neighboring residents and act within common sense.
Supplementary Provisions
1.These accommodation terms and conditions shall be applied from 012/01/2024 (hereinafter referred to as the “effective date”).
2.However, for accommodation contracts that were already established by the day before the effective date, the old accommodation terms and conditions and rules of use shall apply.
